Our fast-growing personal injury firm in Downtown Miami is looking for an experienced Pre-Suit Personal Injury Attorney who thrives in a collaborative, high-performance environment. This is an opportunity to take ownership of your cases from start to finish, supported by a dedicated pre-litigation team that helps you focus on strategy, negotiation, and results.

This is a hands-on position for an attorney who loves strategy, negotiation, and client advocacy. You'll oversee your own caseload from intake through settlement, working closely with a Case Manager, Pre-Lit Paralegal, and Medical Records Coordinators to ensure every case moves efficiently and clients are cared for with compassion and professionalism. You'll handle demands, negotiations, and settlement discussions — maximizing case value while upholding the firm's core standards of integrity, service, and results.

Essential Duties and Responsibilities

CASE MANAGEMENT & STRATEGY

  • Oversee all aspects of pre-litigation: intake, case investigation, insurance claims, demand packages, negotiations, and settlement.
  • Evaluate case value, assess liability and damages, and prepare cases for litigation handoff when necessary.
  • Utilize leverage points (CRNs, bad-faith exposure, insurer tactics) to maximize recovery for clients.

NEGOTIATION & CLIENT ADVOCACY

  • Communicate effectively with clients, adjusters, and opposing counsel to achieve favorable outcomes.
  • Defend case value with strong legal and factual arguments.
  • Collaborate with accounting and lien departments to drive lien reductions (ERISA, Medicare, Medicaid, hospital/provider disputes) and protect client net recovery.

COLLABORATION & TEAMWORK

  • Partner with a Case Manager, Pre-Lit Paralegal, and Medical Records Coordinators to ensure timely progress on every file.
  • Coordinate with the litigation and intake teams for smooth handoffs and unified client experience.
  • Contribute to firm culture by exemplifying professionalism, accountability, and client-first service.

Knowledge, Skills and Abilities

  • Fluent in Spanish (verbal and written).
  • Excellent negotiation, communication, and organizational skills.
  • Comfortable managing a high-volume caseload while maintaining quality and empathy.
  • Must prefer pre-suit (no interest in litigation roles).

 Education & Experience

  • Active Florida Bar license, in good standing.
  • 3–5+ years of plaintiff-side personal injury experience, with a strong focus on pre-litigation
  • Trial experience is a plus but not required.
